In our digitally driven era, having an online presence is integral for businesses and individuals. Ensuring that websites are accessible to everyone, including individuals with disabilities, is not just a legal requirement under the Americans with Disabilities Act (ADA), but it’s also a crucial step toward creating an inclusive online environment. In this blog post, we’ll discuss the challenges associated with free WordPress and Shopify widgets in achieving ADA and Web Content Accessibility Guidelines (WCAG) compliance and explore why choosing the right solution matters.

UNDERSTANDING ADA & WCAG COMPLIANCE?

ADA mandates that businesses and organizations make their digital content accessible, with the WCAG serving as a comprehensive set of guidelines for achieving this goal. These guidelines cover various aspects, from providing alternative text for images to ensuring keyboard accessibility and more.

While platforms like WordPress and Shopify offer free widgets and plugins, relying solely on these solutions may pose challenges in achieving comprehensive ADA compliance. Here are some common limitations:

  1. Incomplete Coverage: Free widgets often address basic accessibility issues but may lack the comprehensive coverage required by the WCAG guidelines.
  2. Customization Constraints: Websites vary in design and structure, and free widgets might not offer the necessary customization options to adapt to diverse layouts.
  3. Limited Support and Updates: Free widgets might lack consistent support and regular updates, leaving websites vulnerable to changes in accessibility standards.

CHOOSING THE RIGHT SOLUTION

To ensure comprehensive ADA and WCAG compliance, it’s crucial to choose a solution that addresses the diverse needs of websites and stays on top of changing legislation about ADA & WCAG compliance. Look for features such as:

  1. Advanced Technology: A solution with advanced technology, possibly utilizing AI, can continuously monitor and make instant adjustments to maintain compliance.
  2. Customizability: The ability to customize features is essential for adapting to the unique design and structure of your website.
  3. Legal Protection: Consider a solution that offers litigation support, providing assistance in the event of legal challenges related to non-compliance.
  4. Regular Updates: A commitment to staying updated with the latest accessibility standards ensures ongoing compliance with evolving guidelines.

IS ADA COMLIANCE MANDATORY FOR WEBSITES?

ADA compliance is not mandatory for your website. The majority of websites you visit are not compliant. That being said, in the the American With Disabilities Act spell out who needs to be compliant. If you are require by law to be ADA compliant then it is strongly recommended that your website be ADA compliant as well.

IN CONCLUSION

Years ago Dominos Pizza lost a case in which the court found that Domino’s Pizza violated the ADA by having an inaccessible website and ordered WCAG compliance. A case brought by an individual that was unable to order a pizza using their website or app due to his disability. Since this courts decision, there have been a large increase in litigation against businesses for non compliance on their website.

This does not only apply to large businesses, in fact small businesses are a target due to the limited funds most have to fight the case in court and there is often a quick settlement to overt court.

While the guidelines for ADA for websites are not law, it is based upon the courts determine of how ADA standards apply to websites. In most cases, they will side with the plaintiff, causing a settlement and legal fees.

With a few hundred dollars per year, it is cheap insurance to become ADA compliant and strongly recommended. All is takes is one person to bring legal action, costing you thousands in the fees and settlements.
